I MODIFICATION I

One thing is always constant: CHANGE. A change in circumstances may warrant a modification in your parenting time schedule, legal decision-making authority or child support. The court examines whether a change in circumstance is deemed significant and on-going, to warrant granting a modification to an existing order.

I CHANGES IN PARENTING TIME I

Often times, the schedule which is initially agreed upon, may need to be adjusted. For example, parents move, change jobs, or remarry. Children often change schools, have demands of extracurricular activities or simply get older. All of these occurrences might impact a family’s schedule; thus a change in parenting time may be in your child’s best interest.

I CHANGES IN LEGAL DECISION-MAKING I

As children develop, so do their educational, medical and spiritual needs. While parents may have been able to successfully make joint decisions together regarding their child, life events may happen which result in an impasse. Generally, the court will not make decisions in place of a parent, but more often, will consider awarding one parent final or sole legal decision-making authority on a specific issue. Filing a Petition for Modification is advisable to secure the ability to make the best decisions on behalf of your child.

I CHILD SUPPORT MODIFICATION I

Individual incomes can vary from year-to-year or upon new employment/job loss.  Parenting time schedules can change. These factors are applied when seeking a modification for child support in the application of the Arizona Child Support Guidelines.
