I GRANDPARENTS RIGHTS I

Many times grandparents are a casualty in the midst of a divorce between their child and his/her spouse. While they once may have had unlimited access to spending time with their grandchild(ren), such time may now be restricted or prohibited.  By statute, grandparents have rights and may petition the court for visitation, legal decision-making authority or even placement in certain circumstances. 


I THIRD PARTY RIGHTS I

Similar to grandparents rights, a person other than a child’s legal parent may petition the court for either visitation, placement or legal decision-making authority.

 

While there are many statutory requirements and factors a court will consider, the goal is to always act in the child’s best interest.
